What Loxa does
Loxa shows you what a hair style and colour might look like on a photo of you. The images are generated by a model and are an illustration, not a promise: a real result depends on your hair, your stylist and things a photograph cannot know. Take one to a salon as a reference, not as a guarantee.
Who can use it
You need to be 16 or older to use Loxa. If you are younger than that, please do not use the app. We do not knowingly take photos or purchases from anyone under 16, and if we learn that we have, we will delete what we hold.
Credits
A credit is one generated photo. The first photo on a new device is free. The weekly subscription includes 20 photos each week. New subscribers pay $0.99 for the first week, then $2.99/week until cancelled; the introductory price is offered once per Apple ID, so it does not apply if you have subscribed to Loxa before. The weekly photos reset every Monday and do not carry over; a photo you buy singly never expires. If you run out you can buy a single photo for $0.99. Prices are shown in your own currency in the app, and the price the App Store charges is the one that counts. Photos are tied to the device the app is installed on, and stay with it if you reinstall. Restore purchases brings back an active subscription on a new phone; single photos you bought stay with the device they were bought on, because Apple does not restore one-off purchases.
Cancelling
The subscription renews automatically each week until you cancel. Cancel at least 24 hours before the week ends, in your Apple ID settings rather than in the app — cancelling stops the next renewal, and the week you have paid for runs to its end. Payment is charged to your Apple ID when you confirm the purchase and at each renewal.
Refunds
Apple sells the subscription and the single photos, takes the payment and handles refunds — we cannot issue one. Ask Apple at reportaproblem.apple.com. Where the law gives you a right to withdraw from a purchase, that right stands whatever else these terms say. A credit that has been spent on a generated photo has been used, and we cannot restore it, though we are happy to hear from you if something went wrong.
Your photos, your rights
You keep every right you have in the photos you upload and in the images Loxa generates from them. We claim no ownership of either. You give us permission to do the one thing the app exists to do: send your photo to the image model, have it restyled, and return the result to you — and to keep the result briefly so that repeating the same request does not cost you a second credit. That permission covers nothing else. We do not use your photos to train anything, we do not publish them, and it ends when the image does.
What not to upload
You confirm that you may use the photo you upload — in practice, that it is of you, or that whoever is in it agreed. Do not upload photos of other people without their permission, photos of children, or anything illegal, and do not use Loxa to impersonate someone, to harass anyone, or to make images intended to deceive. Do not try to break, overload or work around the app or its servers, and do not use it through anything other than the app itself.
No guarantee
Loxa is provided as it is. We do not promise that it will always be available, that a generated image will resemble what a stylist could actually achieve, or that the app will be free of faults. To the extent the law allows, we exclude the implied warranties that would otherwise apply. Nothing here takes away consumer rights you have under the law where you live.
Limits on our liability
To the extent the law allows, we are not liable for indirect or consequential loss, for lost data, or for anything that follows from a decision you made about your hair on the strength of a generated image. Where we are liable, our total liability is limited to what you paid us in the twelve months before the claim. We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us exclude.
Ending your access
You can stop using Loxa at any time by deleting the app, and cancel the subscription in your Apple ID settings. We may suspend or end access if these terms are broken — for instance by uploading photos of people who did not agree — and if we do, we will refund any unused time on a subscription unless the reason for ending it was serious.
Changes to these terms
We may change these terms as the app changes. The date at the top says when they were last updated, and continuing to use Loxa after a change means the new terms apply. If a change materially reduces what you get for what you pay, you can cancel; the week you have paid for still runs to its end.
Apple
These terms are between you and BLANK HEXADECIMAL, S.L., not Apple. Apple is not responsible for Loxa or for anything in it, has no obligation to support it, and is not responsible for any claim you might have about it — including product liability, a failure to meet a legal requirement, or a claim under consumer protection law. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you directly. You confirm you are not in a country subject to a US Government embargo, and that you are not on a US Government list of prohibited or restricted parties.
Law and courts
These terms are governed by the law of Spain, and the courts of Madrid, Spain have exclusive jurisdiction over any dispute — except that if you are a consumer, you keep the protection of the mandatory law of the country you live in, and may bring a claim in your own courts.
If part of this does not hold
If any part of these terms turns out to be unenforceable, the rest of them continue to apply.
